Helped or needed

Parking pressure without maximum parking

  1. No unacceptable parking pressure

The inspector was satisfied that the evidence showed no unacceptable parking pressure or related highway-safety harm.

  2. Maximum parking was not decisive

Despite not providing maximum parking standards, the scheme was found broadly consistent with wider highway-safety and sustainable-transport aims.

  1. Does the refusal identify parking pressure, not only parking numbers?
  2. Does it specify missing evidence on deliveries, servicing or emergency access?
  3. Does it identify a road-danger or transport-capacity problem?

Appeal 89459 was dismissed for need and housing-stock reasons despite acceptable highway safety. It is an edge-of-scope example. These decisions do not predict another result.

Each example separates the development, the Inspector-stated issue that selected it, and the reasoning from the decision. Compare the facts as well as the outcome: these examples do not predict how a different proposal would be decided.

Allowed appeal examples

  1. 6000305

    19 November 2025 · Allowed

    Development described in the decision

for the demolition of the existing car repair garage with a replacement building of 3 storeys, plus lower ground floor, comprising 7 self-contained residential units with associated cycle parking, refuse storage and amenity space.

    Issue identified by the Inspector

The main issues are the effect of the proposed development on: • parking pressure and highway safety; • the character and appearance of the area; and • the living conditions of neighbouring occupiers with regard to privacy.

    Paragraph 6 · Source page 2

    Reasoning from the decision

Overall, based on the evidence before me, I am satisfied that the proposal would not result in unacceptable parking pressure and would not harm highway safety in this regard. There would be some conflict with Policy T6.1 of the LP and Policy TRC03 of the BLP in that the scheme would not provide the maximum parking standards. However, for the reasons outlined, I am satisfied that the scheme would broadly comply with the wider aims of Policies T4, T6.1 of the LP and Policy TRC03 of the BLP and that of the National Planning Policy Framework (the Framework) of ensuring highway safety and promoting sustainable modes of transport.

    3 June 2026 · Dismissed

    Development described in the decision

No verified development description was available for this example.

    Issue identified by the Inspector

The main issues are the effects of the proposed development on: • the character and appearance of the area • the living conditions of surrounding and future occupiers in relation to outlook • highway safety.

    Paragraph 2 · Source page 1

    Reasoning from the decision

Thus, with the absence of substantive evidence to the contrary, I must conclude the proposal would harm highway safety. It would therefore conflict with BLP Policy TRC03 and [name] T4 and T6 which seek, amongst other things, appropriate provision for efficient deliveries, servicing and emergency access, for development proposals to reflect and be integrated with current and planned transport access, capacity and connectivity and avoid an increase in road danger.

    Paragraph 12 · Source page 3

  2. 6004245

    28 May 2026 · Dismissed

    Development described in the decision

described on the application form as “change of use of a house in multiple occupation (C4) to a children's home for up to three children, with a manager and up to two carers staying overnight working on a rota basis (C2)”.

    Issue identified by the Inspector

The main issues are: • whether the proposed development would meet an identified need, having regard to its provision of housing choice for people with social care and health support needs; • the effect of the proposed development on the housing stock in Barnet; • the effect of the proposed development on the character of the surrounding area; • the effect of the proposed development on the living conditions of neighbouring occupiers, with particular regard to noise and disturbance; and • the effect of the proposed development on highway safety and the free flow of traffic, with particular regard to parking provision.

    Paragraph 4 · Source pages 1, 2

    Reasoning from the decision

I am satisfied that the proposed development would not harm the character of the area, would be acceptable in terms of the living conditions of neighbouring occupiers, and would have an acceptable impact on highway safety. I also accept that the appeal proposal seeks to provide a children’s home for vulnerable children. Nevertheless, it has not been demonstrated that there is an identified need for the proposed use, and the proposal would result in the unjustified loss of a dwelling from the Borough’s housing stock. I therefore conclude that the proposal would conflict with the development plan when read as a whole and that there are no material considerations, including the Framework, that indicate that the proposed development should be determined other than in accordance with it. Therefore, the appeal should be dismissed.

    Paragraph 29 · Source page 6

  3. 6000300

    16 February 2026 · Dismissed

    Development described in the decision

change of use from use class C3 to C4 (HMO).

    Issue identified by the Inspector

The main issues are: i) the suitability of the development in this location having regard to the development plan policies in relation to houses in multiple occupation (HMOs); and, ii) the effect of the development on highway safety, in terms of parking.

    Paragraph 4 · Source page 1

    Reasoning from the decision

[name] have found that the development does not result in unacceptable harm in terms of character and appearance and living conditions, I have found that it is harmful in terms of its access to public transport, its identified need, as well as with regards to highway safety. Therefore, the development is contrary to the development plan as a whole, and there are no other material considerations which outweigh this conflict. For these reasons, I recommend that the appeal is dismissed.

    Paragraph 24 · Source page 4

  4. 6000397

    8 December 2025 · Dismissed

    Development described in the decision

described as ‘Conversion of existing HMO C4 classification into three Flats of C3 self contained use, by way of ground floor rear extension and associated bike store.’

    Issue identified by the Inspector

The main issues are: • whether the proposed change of use would be acceptable, with regard to local need; and • the effect of the proposed development on highway safety, with regard to parking provision.

    Paragraph 5 · Source pages 1, 2

    Reasoning from the decision

Although there would be some conflict with Policy TRC03 of the BLP and Policy T6 and T6.1 of the LP in that the scheme would not ensure car free development, I do not consider that the scheme would result in unacceptable harm to parking provision and highway safety in the area. It would also be broadly in accordance with the provisions of Policy T4 of the LP, which seeks to ensure road safety.
