Charnwood Borough Council appeal findings

Fencing, dormers and Charnwood street character

The selected allowed extracts mainly state conclusions, not the design analysis behind them.

Counted against appeals

Fencing, gates and dormers judged harmful

  1. Fencing and gates dominated the street

The Inspector found the fencing and timber gates visually dominant and discordant in the street scene.

  2. Dormer form appeared incongruous

The Inspector found the dormer’s scale, mass and design made it incongruous and harmful to the area’s character and appearance.

Helped or needed

Allowed extension findings on local character

  1. No unacceptable character effect

For a side extension, the Inspector concluded there would be no unacceptable effect on the area’s character and appearance.

  2. Extensions said to maintain character

For a first-floor side extension, the Inspector concluded the extensions would maintain the area’s character and appearance.

  3. Raised bay was not enough

The Inspector did not consider the bay above the eaves line enough to create policy conflict.

Your refusal notice

Check these details

  1. Does the refusal identify a street-facing feature as visually dominant?
  2. Does it explain harmful scale, mass or design?
  3. Does it say why the proposal would not maintain local character?

These selected examples cover fencing, gates, a dormer and extensions, so they may not match your proposal. These decisions do not predict another result.

    15 April 2026 · Allowed

    Development described in the decision

a single storey and two storey side extension. Alterations.

    Issue identified by the Inspector

The main issue is the effect of the proposed development on the character and appearance of the area.

    Paragraph 4 · Source page 2

    Reasoning from the decision

I therefore conclude that the proposed development would not have an unacceptable impact on the character and appearance of the area. It would comply with Policy DS4 of the Charnwood Local Plan (2026) which requires, amongst other things, that new developments make a positive contribution including by respecting and enhancing the character of the area, having regard to scale and massing.

The main issue is the effect of the proposal on the character and appearance of the surrounding area.

    Paragraph 8 · Source page 2

    Reasoning from the decision

The proposed extensions would maintain the character and appearance of the area and would therefore accord with Policy DS4 of the CLP 2021-2037. Amongst other matters, this policy requires new developments to make a positive contribution to Charnwood by responding positively to local distinctiveness and respecting and enhancing the character of the area.

  3. 3353223

    3 January 2025 · Allowed

    Development described in the decision

No verified development description was available for this example.

    Issue identified by the Inspector

The main issue is the effect of the proposal upon the character and appearance of the area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

Although the raising of the bay above this eaves line slightly compounds this impact of scale, I do not consider that this protrusion is enough to bring this scheme into conflict with Policy CS2 of the Charnwood Local Plan Core Strategy (2011-2028) and saved [name]/1 and H/17 of the Borough of Charnwood Local Plan aswell as Policy DS5 of the Emerging Draft Charnwood Local Plan and the Design Supplementary Planning Document or the Framework. 1. 6001408

    27 February 2026 · Dismissed

    Development described in the decision

the erection of fencing to front and side boundaries and erection of timber gates to front boundary.

    Issue identified by the Inspector

The main issue is the effect of the development on the character and appearance of the area.

    Paragraph 4 · Source page 1

    Reasoning from the decision

Taking all these matters into account, the proposals introduce a visually dominant and discordant feature in the street scene which detracts from the character of the wider area. As such, they conflict with Policy DS4 of the Charnwood Local Plan (2021-2037) which, amongst other things, requires new development to respect and enhance the character of the area.

    Paragraph 12 · Source page 2

  2. 3309026

    27 February 2023 · Dismissed

    Development described in the decision

a loft conversion with rear dormer.

    Issue identified by the Inspector

The main issue in this appeal is the effect of the proposal on the character and appearance of the area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

As a result, due to the scale, mass and design of the dormer, it would appear as an incongruous feature which would cause harm to the character and appearance of the area. I therefore find that the proposal would be contrary to Policy CS2 of the Charnwood Local Plan 2011 to 2028 [name] (2015), [name]/1 and H/17 of the Borough of Charnwood Local Plan 1991-2006 (2004), the Design Supplementary Planning Document (2020) and Policy R03 of the Rothley Parish Neighbourhood Plan 2020-2028 (2021). Amongst other things seeks to ensure development would not result in harm to the character and appearance of the area and is of compatible design with the original dwelling. It would also conflict with the design objectives of the Framework.
