Allowed appeal examples

2 examples

  1. 3279294

    19 November 2021 · Allowed

    Development described in the decision

No verified development description was available for this example.

    Issue identified by the Inspector

The main issue is the effect of the proposal on highway safety.

    Paragraph 5 · Source page 2

    Reasoning from the decision

I find that local circumstances justify the proposed parking arrangement and the development would not result in harm to highway safety. The proposal complies with LP Policy DM27 and NP Policy WNP D1. In addition, it accords with paragraphs 110 to 112 of the Framework, which set out that development should only be prevented if there would be an unacceptable impact on highway safety, and that safe and suitable access for all users should be achieved.

  2. 3345183

    7 October 2024 · Allowed

    Development described in the decision

retrospective application for the conversion of the garage and approval of internal layout changes and new window.

    Issue identified by the Inspector

The main issue is the impact of the proposal upon highway safety.

    Paragraph 3 · Source page 1

    Reasoning from the decision

The Council’s refusal reason is, ultimately, based upon concerns as to highway safety as a result of the proposed parking space, to the side of the garage, being stated to be unsuitable for day to day use as a result of its location which is considered to be constrained due to the adjacent wall and the property boundary. Given the constraints of the space the Council consider that occupiers and visitors are not likely to use it and the result of this is considered that cars would either overhang the bridleway or be parked on the street with the impacts being detrimental to the general safety of all highway users, adding pressure on the road networks, and leading to increased conflict with pedestrians and other vehicles.

  1. 3301572

    11 August 2022 · Dismissed

    Development described in the decision

described as extension and alterations to ground floor.

    Issue identified by the Inspector

The main issue is the effect of the proposed development on highway safety.

    Paragraph 2 · Source page 1

    Reasoning from the decision

I find that the proposal would harm highway safety. There is conflict with Policy DM27 of the Chelmsford Local Plan (2020) which amongst other things seeks to ensure developments provide minimum parking for residential development to address issues of on-street parking.

    Paragraph 9 · Source page 2

  2. 3277465

    8 November 2021 · Dismissed

    Development described in the decision

    the formation of an access.

    Issue identified by the Inspector

I consider the main issue to be the effect of the proposal on highway safety on [address].

    Paragraph 2 · Source page 1

    Reasoning from the decision

For the reasons stated above, I conclude that the proposal would have an adverse effect on highway safety on [address]. Thus, the proposal would be contrary to the National Planning Policy Framework where it seeks to ensure that development proposals do not have an unacceptable impact on highway safety. Since the Council made its decision, the Framework has been revised. Nevertheless, it continues to seek to ensure highway safety.

    Paragraph 8 · Source page 2

  3. 3359951

    5 June 2025 · Dismissed

    Development described in the decision

increased height of front wall with an electric gate and new side wall.

    Issue identified by the Inspector

The main issues raised by this appeal are the effect of the proposed development on the character and appearance of the area and highway safety.

    Paragraph 5 · Source page 1

    Reasoning from the decision

For these reasons, I conclude that the proposed development would be harmful to highway safety. The proposal would, therefore conflict with Policy DM23 of the Chelmsford Local Plan. That policy seeks, amongst other matters, development to create safe, accessible and inclusive environments.
