Dorset Council appeal findings
Dorset access, visibility and reversing
Not every dismissed appeal is displayed, so its inspector reasoning is unavailable here.
Counted against appeals
Dorset's unsafe access and reversing
Inadequate A352 visibility splays
At the A352 access, inadequate visibility splays left the proposal unsafe and harmed traffic flow.
Reversing left pedestrians exposed
The narrow route and small yard made reversing onto the road likely, with little room for pedestrians to move clear.
Completed frontage works changed nothing
The Inspector concluded that the high-standard frontage works did not alter the highway-safety finding.
Helped or needed
Safer access and parking
Alternative parking supported safe access
A new access and alternative parking area gave occupiers safer access without severe harm to other road users.

- Does the refusal identify inadequate visibility splays at your access?
- Could vehicles reverse into the road or pedestrians' path?
- Would alternative parking make access safer for all users?
Appeal 89042 is an edge example: its excerpt finds no highway harm despite dismissal. These decisions do not predict another result.

Each example separates the development, the Inspector-stated issue that selected it, and the reasoning from the decision. Compare the facts as well as the outcome: these examples do not predict how a different proposal would be decided.
Allowed appeal examples
1 example
26 January 2023 · Allowed
Development described in the decision
retrospective permission for the construction of a new access and driveway.
Issue identified by the Inspector
I consider that the main issues in this case are its effect on highway safety, the character and appearance of the area and on the setting of a listed building.
Paragraph 2 · Source page 1
Reasoning from the decision
I consider that, on balance, this new access and alternative parking area provide safer access for the occupiers of [site address] and do not have any severe detrimental effect on the safety of other road users. I conclude that the development will not pose a significant increase in the risk to highway safety and that it is consistent with local plan policy COM7 and the National Planning Policy Framework 2021 (the Framework).

Dismissed appeal examples

23 June 2026 · Dismissed
Development described in the decision
construction of new vehicular access, farm track and turning area and a new agricultural building.
Issue identified by the Inspector
The main issues in this appeal are: • Whether the size of the proposed building is reasonably required for the purposes of agriculture at the site, and the effect of the proposal on the character and appearance of the local area, and • The effect of the proposal on highway safety.
Paragraph 2 · Source page 1
Reasoning from the decision
On the basis of the information before me, I conclude that the proposed development would not provide safe access and would have an unacceptable harmful effect on the free flow of traffic on the A352 and highway safety by reason of inadequate visibility splays. This would conflict with Policy COM7 of the Local Plan and Paragraph 115 b) of the Framework, both of which seek to ensure that new development would create safe and convenient access for all users.
Paragraph 17 · Source page 3
19 May 2026 · Dismissed
Development described in the decision
demolish existing dwelling and construct two semi-detached replacement dwellings.
Issue identified by the Inspector
The main issues are: • whether the site is in a suitable location having regard to policies that seek to control development in rural areas; • whether the proposed development would be at risk of flooding; • whether the proposal would conserve or enhance the character or appearance of the [site address] Conservation Area (CA); and • the effect of the development on highway safety.
Paragraph 2 · Source page 1
Reasoning from the decision
Having paid regard to the Framework and the Council’s highway officer comments, I therefore conclude on this main issue that the proposal would be unlikely to have an unacceptable impact on highway safety. As such, there would be no conflict with LP Policy COM7.
Paragraph 23 · Source page 5
28 November 2023 · Dismissed
Development described in the decision
widening of front gateway at [site address] .
Issue identified by the Inspector
The main issues are: • the effect of the proposed development on the character and appearance of the area, having particular regard to the effect on relevant designated heritage assets; and • the effect on highway safety.
Paragraph 3 · Source page 1
Reasoning from the decision
Given the narrowness of the route and the size of the yard, were a car to be parked at the appeal site, it would likely require reversing out onto [address] and into the path of pedestrians. Pedestrians would be given very little room to get out of the way of a vehicle moving in a forward or reverse gear. There is no legal mechanism that would restrict the development or use of the land in any specified way and consequently no way to prevent cars being parked within the site to effectively mitigate against a potentially detrimental impact on highway safety.
Paragraph 20 · Source page 4
24 March 2023 · Dismissed
Development described in the decision
No verified development description was available for this example.
Issue identified by the Inspector
The main issues are the effects of the proposal upon highway safety and the living conditions of neighbouring occupiers with particular regard to noise, disturbance and privacy.
Paragraph 5 · Source page 1
Reasoning from the decision
For the reasons given, I find that the proposal would be harmful to highway safety and the living conditions of adjoining occupiers. I appreciate that the works to provide a level surface to the site’s frontage have been undertaken to a high standard, and that the appellant originally believed that planning permission may not have been required. However, neither of these factors, nor any other issues raised, alter my conclusion that the appeal should be dismissed.
