Each example separates the development, the Inspector-stated issue that selected it, and the reasoning from the decision. Compare the facts as well as the outcome: these examples do not predict how a different proposal would be decided.
Allowed appeal examples
1 example
7 July 2025 · Allowed
Development described in the decision
replacement front elevation windows.
Issue identified by the Inspector
The main issue is the effect on the character and appearance of the appeal dwelling and that of the [address] Deal Conservation Area (the CA).
Paragraph 3 · Source page 1
Reasoning from the decision
For these reasons, the proposal development would not result in any significant harm to the character and appearance of the appeal dwelling or that of the CA. This would accord with Policies PM1 and HE2 of the Dover District Local Plan to 2040 (2024) and section 16 of the Framework. Collectively these seek to ensure that development is of high quality design, demonstrates an understanding of context and historic architectural character and preserves or enhances heritage assets.

Development described in the decision
No verified development description was available for this example.
Issue identified by the Inspector
The main issue is the effect of the development on the character and appearance of the area.
Paragraph 3 · Source page 1
Reasoning from the decision
Drawing the above together, the size, siting and design of the shed in a prominent front garden location, has caused harm to the character and appearance of the area. It is therefore contrary to paragraphs 131-141 of the Framework which stresses the importance of development adding to the overall quality of an area, being visually attractive and being sympathetic to the surrounding built environment. It is also contrary to emerging Policy H6 of the Submission Draft Dover District Local Plan 2023, which says that development should be compatible with the appearance of the existing settlement.

14 August 2023 · Dismissed
Development described in the decision
removal of existing shed and the erection of outbuilding for home office.
Issue identified by the Inspector
I consider that the main issue in this case is its effect on the character and appearance of the area.
Paragraph 3 · Source page 1
Reasoning from the decision
I conclude that the proposal would harm the character and appearance of the area, contrary to the Framework and local plan policy PM1.

22 June 2023 · Dismissed
Development described in the decision
No verified development description was available for this example.
Issue identified by the Inspector
The main issue is the effect of the development having regard to the character and appearance of the surrounding area.
Paragraph 3 · Source page 1
Reasoning from the decision
The proposed garage would be sited forward of the host property and would be clearly evident from the highway. The scheme would erode the spacious character of the locale due to its size and siting forward of the established building line on [site address] . The impact would be harmful to the relationship between residences and adjoining spaces, and thus the character and appearance of the area in what is a prominent location. _________________________________________________________________________________ __________________________________________________________________________________________
Paragraph 6 · Source pages 1, 2
22 June 2026 · Dismissed
Development described in the decision
Erection of an agricultural dwelling with associated garden and parking.
Issue identified by the Inspector
The main issues are: • whether there is an essential need for a dwelling to accommodate a rural worker at the appeal site, and • the effect of the development on the character and appearance of the area.
Paragraph 5 · Source page 1
Reasoning from the decision
[name] have not identified an essential need, the proposal fails to demonstrate the exceptional circumstances required to justify a new dwelling in the countryside. In addition, whilst the harm to character and appearance, including landscape character, would be localised and modest, it nonetheless adds further weight against the proposal. Accordingly, the proposal would conflict with the development plan as a whole, and there are no material considerations which indicate that the appeal should be decided other than in accordance with it. Therefore, the appeal is dismissed.
