Dudley Metropolitan Borough Council appeal findings

Garage siting and extension mass in Dudley streets

Allowed decisions appear more often among the selected examples than across the matched local set, and one dismissed extract gives only a conclusion.

Counted against appeals

Where Dudley additions harmed street character

  1. Front garage siting and scale

The detached triple garage was found materially harmful to the area because of its siting and scale.

  2. Whole extension assessment

The Inspector concluded that the double-storey side extension, considered as a whole, did not meet design, character and appearance requirements.

Helped or needed

What avoided harm to Dudley street character

  1. Street scene was respected

The extension was judged to respect the existing property and street scene.

  2. Outbuilding was not imposing

The garage and gym outbuilding would not be imposing or have a harmful relationship with the host property or surrounding area.

  3. Spacious, dog-legged siting

Although relatively large, the proposal would not be unduly dominant because of its spacious setting and dog-legged siting.

Your refusal notice

Check these details

  1. Does the refusal identify harmful siting, scale, mass or street-scene effects?
  2. Does it explain why your proposal would look imposing or dominant?
  3. Could a smaller or differently positioned design answer the stated concern?

The selected examples concern garages, outbuildings and extensions, not every type of Dudley proposal. These decisions do not predict another result.

  1. 3362757

    3 June 2025 · Allowed

    Development described in the decision

described as “demolish existing single storey side extension and construct two storey side extension.”

    Issue identified by the Inspector

The main issue is the effect of the proposed development on the character and appearance of the area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

I am therefore satisfied that the proposed extension would respect the character and appearance of the existing property and of the street scene. There would be no conflict with Policies L1 and S6 of the Dudley Borough Development Strategy (2017) and the guidance contained within the SPD which together seek to ensure that the design of extensions is an appropriate form, scale and mass and responsive to the context and character of the surrounding area.

  2. 3333994

    22 April 2024 · Allowed

    Development described in the decision

a garage and gym outbuilding and new brick wall and piers to the rear of [site address] (accessed from [address]).

    Issue identified by the Inspector

The main issue is the effect of the development on the character and appearance of the area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

Overall, I find that the outbuilding would not be an imposing structure and would not have a harmful relationship with the host property or the surrounding area. As such, the proposal would accord with Policy ENV2 of the Black Country Core Strategy, Policies S6 and L1 of the Dudley Borough Development Strategy and the Dudley Borough Residential Design Guide SPD (2023). Together and amongst other matters, these policies and guidance, require development to be of a high quality, to be in keeping with the character of the built environment, to be of an appropriate form, siting, scale and mass and not be detrimental to the host dwelling. Similarly, the proposal would accord with the National Planning Policy Framework (the Framework), which states that developments should be sympathetic to local character.

  3. 3307918

    3 March 2023 · Allowed

    Development described in the decision

an increase in roof height to facilitate loft conversion with front and rear dormer.

    Issue identified by the Inspector

The main issue in this case is the effect of the proposed development on the character and appearance of the area.

    Paragraph 3 · Source page 1

    Reasoning from the decision

Whilst the proposal would be relatively large, it would not appear unduly dominant, due partly to the spacious setting of the host property and particularly, to the “dog-legged” siting of the extension, whereby the proposal would appear to turn the bend along [address] in a neat and satisfactory manner. 10.Further to the above, the heightened eaves of the proposal’s rear elevation would result in it wrapping around part of the appeal property’s rear garden in a sensitive manner, such that the addition would add visual interest in a way that ties-in well with and appears subservient to, the host dwelling. 11.Taking all of the above into account, I consider that the proposal would make a positive contribution to local character. 12.The proposed development would not harm the character and appearance of the area and would not be contrary to the National Planning Policy Framework, to Core Strategy1 Policy ENV2; to Development Strategy2 Policies L1 and S6; or to the [address] Extensions SPG3, which together amongst other things, seek to protect local character. 1 Reference: Black Country Core Strategy (2011). 2 Reference: Dudley Borough Development Strategy (2017). 3 Reference: Supplementary Planning Guidance Note 17 ([name]) (1998). 2

Dismissed appeal examples

  1. 6001495

    25 February 2026 · Dismissed

    Development described in the decision

described as erection of detached triple garage to front.

    Issue identified by the Inspector

The main issue is the effect of the proposed development on the character and appearance of the surrounding area.

    Paragraph 3 · Source page 1

    Reasoning from the decision

I conclude that by virtue of its siting and scale the garage would be materially harmful to the character and appearance of the area. It would conflict with policies S6 and L1 of the Dudley Borough Development Strategy. Amongst other matters, these policies require that development addresses character and appearance and secures a design that is of an appropriate form, siting, scale and mass.

  2. 3335852

    5 April 2024 · Dismissed

    Development described in the decision

described as a double storey side extension with new porch design.

    Issue identified by the Inspector

The main issue is the effect of the development upon the character and appearance of the area.

    Paragraph 5 · Source page 1

    Reasoning from the decision

I therefore conclude that, when the proposal is considered a whole, it does not accord with the design, character and appearance requirements of policies ENV 2 and ENV 3 of the Black Country Core Strategy 2011, policies L1 and S6 of the Dudley Borough Development Strategy 2017, the Dudley Council Residential Design Guide SPD 2023, the National Design Guide and chapter 12 of the Framework.
