North Northamptonshire Council appeal findings

When garage and boundary changes harm area character

The selected examples include detailed dismissed reasoning, but the allowed extracts give only no-harm conclusions.

Counted against appeals

Garage, car port and fence concerns

  1. Garage no longer read as secondary

Its scale, bulk and height drew attention, weakening its visual link to the main house and the transition between nearby properties.

  2. Front car port harmed building and area

The Inspector concluded that the front car port harmed the existing building and surrounding area.

  3. Outward fence move harmed the area

Relocating the fence and changing the land use were found harmful to the area’s character and appearance.

Helped or needed

Allowed extensions: no area harm found

  1. Extension and conservatory found acceptable

The Inspector concluded that the extension and conservatory refurbishment would not harm the area’s character and appearance.

  2. Alterations found not harmful

The Inspector concluded that the extensions and alterations would not harm the area’s character and appearance.

Your refusal notice

Check these details

  1. Does your refusal identify scale, bulk or height as excessive?
  2. Would an addition still read as secondary to the main house?
  3. Would a front structure alter the existing building or surrounding area?

The examples cover particular extensions, garage work, a car port and a fence change, not every proposal. These decisions do not predict another result.

Each example separates the development, the Inspector-stated issue that selected it, and the reasoning from the decision. Compare the facts as well as the outcome: these examples do not predict how a different proposal would be decided.

Allowed appeal examples

  1. 3342108

    3 September 2024 · Allowed

    Development described in the decision

described as proposed 2-storey extension and refurbishment of existing conservatory.

    Issue identified by the Inspector

The main issue is the effect of the proposed development on the character and appearance of the area.

    Paragraph 3 · Source page 1

    Reasoning from the decision

I therefore conclude that the proposal would not be harmful to the character and appearance of the area and would accord with Policy 8 of the [name] (Adopted 2016) and Policy H6 of the Cottingham Neighbourhood Plan ([name] 2022). Collectively these policies seek to secure high quality design where the character, scale, mass, density and layout of development fit in with the aspect of the surrounding area. Nor do I find conflict with the Framework which requires developments to be sympathetic to local character.

  2. 6004578

    7 April 2026 · Allowed

    Development described in the decision

    for extensions and alterations.

    Issue identified by the Inspector

The main issue is the effect of the proposal on the character and appearance of the surrounding area.

    Paragraph 3 · Source page 1

    Reasoning from the decision

I conclude that the proposed extensions and alterations would not harm the character and appearance of the area. It would therefore accord with Policy 8 of the [site address] [name], Policy EN11 of the East Northamptonshire Local Plan Part 2 and Policy HDN1 of the Stanwick Neighbourhood Development Plan. Amongst other matters, these policies seek to create a distinctive local character by responding to the site’s immediate and wider context and local character to create new streets, spaces and buildings which draw on the best of that local character without stifling innovation.

  1. 3300352

    17 August 2022 · Dismissed

    Development described in the decision

to extend above existing detached garage to form playroom.

    Issue identified by the Inspector

The main issue is the effect of the proposed development on the character and appearance of the local area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

From the [address] and [address] junction, the proposal would draw the eye given that its scale, bulk and height would be atypical of an ancillary building or a double garage in a residential area. It would disrupt the relationship to the main house because the completed building would no longer visually ‘read’ as clearly subordinate to it. By introducing additional built form in a prominent location, the appeal scheme would also diminish the space above the garage. In doing so, the subtle role of the site in the townscape by providing a smooth visual transition between contrasting properties within and just beyond the CA would be undermined. For all of these reasons, I consider that the proposal would introduce a discordant element and that it would be deleterious to the character and appearance of the local area.

  2. 3357324

    23 June 2025 · Dismissed

    Development described in the decision

    car port to front elevation.

    Issue identified by the Inspector

The main issue is the effect of the proposed development on the character and appearance of the existing building and the surrounding area.

    Paragraph 4 · Source page 1

    Reasoning from the decision

I therefore conclude that the proposal would have a harmful effect on the character and appearance of the existing building and the surrounding area. It would conflict with Policy 8 of the [name] 2011-2031 (2016), Policy EN11 of the East Northamptonshire Local Plan Part 2 2011-2031 (2021) and Policy EN1 of the Rushden Neighbourhood Plan (2018). These require that development proposals respond positively to the site’s context and character, create a continuity of street frontage in terms of appearance and use materials that respect and complement existing neighbourhood properties and those in the vicinity of the application site.

  3. 3312741

    4 April 2023 · Dismissed

    Development described in the decision

change of use of land to allow for relocation of the fence outwards to make room for a garage extension.

    Issue identified by the Inspector

The main issue is the effect on the character and appearance of the area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

Whilst other elements of the scheme may be acceptable the change of use of the land and relocation of the fence would harm the character and appearance of the area. It would therefore conflict with the part of Policy 8 of the [name] which requires development to respond to the sites immediate and local character.
