Section 01
Development description
described as ‘a retrospective planning application to retain the fence’.
Section 02
Decision
The appeal is allowed and planning permission is granted for a fence at [site address] in accordance with the terms of the application, 23/1370N, dated 6 April 2023, and the plans submitted with it.
Section 03
Main Issue
The main issue in this case is the effect of the fence on the character of the streetscene.
Section 04
Reasons
No. [site address] (No.17) is a two-storey detached house, located on the south side of [address], a residential cul-de-sac. [address] is characterised by similar houses set back from the road with open plan frontages, driveways and front gardens.
[name].[address], with its garden to the rear, its side boundary is formed by the cul-de-sac as it curves south. No.17 is the only house in the cul-de-sac with this arrangement. From the information before me, the original fence line to the side of No.[address] behind a generous grass verge and hedging. This fence has been replaced with a new timber panelled fence with concrete base and posts, extended closer to the road to enclose more of the rear garden.
It is accepted that this results in the loss of part of the verge, but I observed on my site visit that the fence has been set back a sufficient distance to retain a reasonable area of verge and allow the planting of a landscape margin. This, once established, will soften the appearance of the fence, which I do not find, in any event, results in visual harm. Close boarded fences of this type and height (around 1.8m) are common in residential cul-de-sacs and the fence erected to enclose the garden of No.17 does not appear either oppressive or overly dominant. It does not detract from the open plan frontages, or the character of the streetscene.
Consequently, there would be no conflict with the guidance in the National Planning Policy Framework (2023), Policy SE1 and SD2 of the Local Plan Strategy 2010-2030 (2017) and GEN1 of the Site Allocations and Development Policies Document (2022). Together, and amongst other things, these seek to ensure high quality design solutions that protect and enhance local character and distinctiveness.
Section 05
Conditions
In addition to the standard time limit for implementation, the Council has suggested conditions that the development be carried out in accordance with the approved plans and the external surfaces match the existing. As the fence has been constructed (and the application made retrospectively), these conditions are not necessary and accordingly have not been imposed.
Section 06
Conclusion
For the reasons given above, I conclude that the appeal should be allowed.
