Section 03
Background and Main Issue
Schedule 2, Part 1, Class A of the Town and Country Planning (General Permitted Development)(England) Order 2015 (as amended) (‘the GDPO’) permits the enlargement, improvement or other alteration of a dwellinghouse.
The Council considers that the extension would extend beyond a wall forming a side elevation of the original dwellinghouse and would have a width greater than half the width of the original dwellinghouse, thereby not complying with the limitations set out in A.1 (j) of the GPDO.
Consequently, the main issue in this appeal is whether the proposed development constitutes permitted development.
Section 04
Reasons
The proposed extension would extend across the whole of the rear elevation of the dwelling and replace a conservatory which had already been demolished at the time of my visit. The conservatory had been added to the rear of the property in 1985.
However, the evidence before me indicates that when the conservatory was erected, it was done so in place of an outrigger on the rear of the original building1. I have not been provided with details of the size or position of the outrigger but the Council say that it appears on historic maps dating back to 1950-1965 and describe it as a small projection forming part of the original building. 1 Defined in the GPDO as in relation to a building existing on 1st July 1948, as existing on that date and in relation to a building built on or after 1st July 1948, as so built.
The appellant does not dispute that there had been an outrigger to the rear of the building which was replaced by the previous conservatory.
The outrigger would have had a side wall and this would constitute a wall forming a side elevation of the original dwellinghouse. The proposed rear extension extending across the full width of the rear elevation of the dwelling would have a width greater than half the width of the original dwellinghouse.
I note the appellant’s references to other extensions in the street but whether or not they comply with the Order is not relevant to my determination of this particular case.
I therefore conclude that on balance and in the absence of evidence to the contrary, the proposed extension would not constitute permitted development under Schedule 2, Part 1, Class A of the GPDO. As the proposal does not constitute permitted development, the appeal fails and I do not need to consider the living conditions of neighbouring occupiers, which was the Council’s second reason for refusal.
