Section 01
Development description
described on the planning application form as ‘New driveway and crossover’.
Section 02
Decision
The appeal is dismissed.
Section 03
Main Issue
The main issue in this appeal is the effect of the proposed development on highway safety particularly in respect of the safety of users of the footway.
Section 04
Reasons
A number of properties on [address] have on-site parking. However, this tends to be provided at end of terrace properties where parking can be accommodated in the space between the blocks of houses. Where parking occurs to the front of the properties, in the same manner as proposed in this appeal, I saw that these accommodate a small sized car and that larger cars (including the one at No. 45) tend to overhang the pedestrian footway. There is no evidence before me to indicate that these have the benefit of planning permission.
The proposed driveway would fall short of the minimum depth of 4.5 metres as set out in the Council’s ‘Provision of Footway Crossover Policy and Guidelines adopted 3 August 2018. At 4.23m deep, the appeal proposal would accommodate small to medium size cars, mopeds and motorcycles. However larger cars would overhang the pavement, obstructing pedestrian movement and forcing them to move out into the road. Therefore, rather than improving road safety as suggested by the appellant, this would compromise the safety of pedestrians and other users of [address].
Given the site’s location opposite a school, I accept that [address] is busier at certain times and parking is limited. However, I am not convinced that a single-vehicle driveway would noticeably ease congestion.
Whilst the provision of electric charging would be a benefit, occupiers of the property could not be compelled to use it and in any event, it would not overcome the harm I have identified.
The provision of permeable paving to prevent localised flooding is neutral in my assessment and weighs neither in favour nor against the proposal.
I therefore conclude that the proposal would be contrary to Policy T4 of The London Plan adopted March 2021 and Policy 32 of the Bromley Local Plan, adopted January 2019 which seek to ensure that proposals do not increase road danger and that road safety is not significantly adversely affected.
Section 05
Conclusion
The proposed development would be contrary to the development plan and there are no material considerations that outweigh this conflict. Consequently, with reference to Section 38(6) of the Planning and Compulsory Purchase Act 2004, the appeal is dismissed.
