Section 03
Reasons
I attempted to carry out an access required site visit on 23 March 2026. Despite written notification of a time slot for my arrival having been provided in advance, neither the appellant nor their representative was in attendance to provide access and no arrangements had been made for me to gain access to the site. It was not possible for me to view the whole site, in particular the rear garden, from publicly available land.
A further site visit was arranged for 2 June 2026 but again, no one was in attendance to provide access to the site when I arrived at the pre-arranged time.
Section 79 (6A) of the Town and Country Planning Act 1990 (as amended) allows for an appeal to be dismissed where the appellant is responsible for undue delay in the appeal process. Notice of this was given to the appellant in correspondence dated 4 June 2026 (‘the Notice’). This outlined the necessary steps the appellant was required to follow, along with a specified timeframe, to enable the appeal to progress.
As the period specified in the Notice has now passed and the appellant has failed to respond, I find that the appellant is responsible for undue delay in the progress of this appeal.
Accordingly, pursuant to the powers in Section 79 (6A), I conclude the appeal should be dismissed.
