Section 01

Development description

the creation of vehicular access and hard standing.

  1. Section 02

    Decision

The appeal is allowed and the details submitted pursuant to conditions No 2 attached to planning permission [name]/K2230/D/25/3360101 granted on 25 April 2025 in accordance with the application Ref 20250575 dated 9 June 2025 and the plans submitted with it, as amended by the appellant’s Statement of Case, are approved. For the avoidance of doubt, the approved details are contained in the appellant’s Statement of Case and are as follows: - the use of block paving (50mm [name] 3 size Natural) to the full extent of the driveway hardstanding, with no loose gravel or pea shingle; and - the use of reclaimed bricks from the existing boundary wall and the use of [name] 65mm [name] for the construction of the new boundary wall.

  2. Section 03

    Procedural Matter

During the course of the appeal, the appellant submitted revised details of the proposed materials. These were shared with the Council. Therefore, I have taken these revised details into account in determining the appeal.

  3. Section 04

    Main Issue

The main issue is the effect of the proposed materials on highway safety.

  4. Section 05

    Reasons

The application to discharge condition 2 was refused because the submitted details lacked clarity and relied on the use of loose pea shingle for the driveway, which could deposit onto the highway and pose a danger to other road users.

The submitted revised details confirm that the hardstanding would be formed entirely of block paving, with no loose gravel or pea shingle. The use of block paving would not result in debris on the highway and would therefore not obstruct other road users such as pushchairs, wheelchairs or pedestrians. In my view, the proposed materials would be appropriate for their intended use.

The Council had concerns regarding the clarity of the plans and how the shingle and pavers would be laid out. Given it is now proposed to pave the entire driveway, it is considered that the plans are sufficiently clear and adequate.

The local planning authority has confirmed that it raises no objection to the revised materials. On this basis, I am satisfied that the proposal would not give rise to harm to highway safety and that the requirements of condition 2 are met.

  5. Section 06

    Conclusion

For the reasons given above, the appeal is allowed in relation to the details submitted pursuant to condition 2.
