Section 01

Development description

demolition of existing storage building and erection of a single family dwelling.

  1. Section 02

    Decision

    The appeal is dismissed.

  2. Section 03

    Applications for costs

An application for an award of costs was made by [name] (Silver Bayis Ltd) against Broxbourne Borough Council. This is the subject of a separate decision.

  3. Section 04

    Preliminary Matters

The appeal is connected to another scheme on part of the same site1. I have dealt with the two proposals in separate decisions here. However, as there are related issues insofar as it pertains to vehicle parking and highway safety, there will be an element of cross referencing.

  4. Section 05

    Background and Main Issue

Planning permission was granted for a new dwelling in October 2024 subject to conditions, of which conditions 2 and 10 required the dwelling to be built in accordance with the approved details and for the parking provision to be laid out prior to first occupation. Prior approval has also been granted for the use of part of the ground floor for two flats 2. This proposal seeks to reduce the total number of 1 Inspectorate ref: 6001388 2 Council ref: 07/24/0080/P4D parking spaces available on the whole site from four to three which, in effect, would mean that the proposed dwelling would have no dedicated parking provision and would be car free.

Therefore, the main issue is whether the condition is reasonable and necessary having regard to parking provision and the effects on the amenity of the occupants of the proposed dwelling and highway safety.

  5. Section 06

    Reasons

The appeal proposal is part of the wider site that exists at [site address] . This, at present, includes ground floor retail, an indeterminate use of the first floor, seven lock-up garages together with an extant approval for the conversion of part of the ground floor to two flats. It is unclear to me what the parking demand for the existing site is. It is therefore difficult to make a reasoned assessment of the likely resultant parking demand.

The appeal has been submitted with a parking survey that indicates a relatively high degree of on-street parking pressure. Even so, I accept that the site is in a sustainable location, close to local facilities and public transport infrastructure. However, in the absence of any form of clear picture as to the effects of all the proposed developments on this site, I am unable to form an informed conclusion on the effect of the removal of one parking space for the proposed dwelling.

Therefore, I cannot be certain that the proposed development would not result in adverse impacts on parking provision and highway safety in the area. As such, the proposal conflicts with policy TM5 of the Broxbourne Local Plan 2020 as insufficient detail has been provided to give an informed decision.

  6. Section 07

    Conclusion

The proposal conflicts with the development plan and the material considerations do not indicate that the appeal should be decided other than in accordance with it. The appeal is dismissed.
