Section 01
Development description
a proposed single storey rear extension measuring 4.5m long and 3.5m high with eaves height at maximum 3m.
Section 02
Decision
The appeal is allowed and planning permission is granted for a proposed single storey rear extension measuring 4.5m long and 3.5m high with eaves height at maximum 3m at [site address] , Mitcham [postcode] in accordance with the terms of the application, Ref 25/P2316, and the plans submitted with it.
Section 03
Preliminary Matters
Under Article 3(1) and Schedule 2, Part 1, Class A of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) (the GPDO), planning permission is granted for the enlargement of a dwellinghouse subject to limitations and conditions.
Where an application is made for a determination as to whether prior approval is required for development which exceeds the limits in paragraph A.1(f) but is allowed by paragraph A.1(g) to Part 1, paragraph A.4(3) provides that the local planning authority may refuse the application where it considers that the proposed development does not comply – or that the developer has provided insufficient information to enable the authority to establish whether the proposed development complies with the conditions, limitations or restrictions that are applicable to such permitted development.
Section 04
Main Issue
The main issue in this appeal is whether the proposed development would be granted planning permission by Article 3, Schedule 2, Part 1, Class A of the GPDO.
Section 05
Reasons
The Council expressed concerns that the dimensions of the extension stated on the application form were inconsistent with those on the plans. I concur with this assessment as there are differences, particularly in relation to the height of the extension.
However, in either interpretation of the dimensions given, the proposed development would still fall within the limits set out in the GDPO. Thus, the fairly minor discrepancies between the plans and application form are moot in this context as there is sufficient information to establish that the proposed development complies with the conditions, limitations or restrictions that are applicable. As such, prior approval may be granted.
Section 06
Conditions
Any planning permission granted under Article 3(1) and Schedule 2, Part 1, Class A of the GPDO is subject to the conditions in A.3 and A.4. This includes the requirement for the exterior materials to be similar to those used in the construction of the exterior of the existing dwellinghouse and that the development is carried out in accordance with the details and plans submitted as part of the application to the local planning authority. In my view, no further conditions are necessary.
Section 07
Conclusion
For the reasons given above, I conclude that the appeal should be allowed and prior approval is granted.
