Section 01
Development description
a single storey side extension.
Section 02
Decision
The appeal is allowed and the planning permission Ref 1120/25 for a single storey side extension at [site address] , [name], Romford, Redbridge [postcode] granted on 25 July 2025 by the Council of the London Borough of Redbridge, is varied by deleting condition No. 3.
Section 03
[name]
In the description of development above and in my formal decision I have removed the reference to the scheme being retrospective, as this is not a form of development.
Section 04
Background and Main Issue
Planning permission for the single storey side extension included a condition to ensure the use of the side extension as a home office/ storage/ gym area/ bathroom remained incidental and subservient to the primary use of the main dwelling house and did not become a separate or dominant use, including use as sleeping accommodation. The Council indicates that this is in order to prevent a separate use operating from the site, which may lead to an inappropriate and over intensive use of the site.
The appellant objects to this condition for various reasons, primarily relating to the loss of a rest space if they choose to nap or rest in the extension, and the inability to host family as they cannot sleep overnight in the extension. They therefore contend that the condition does not meet various tests set out in the Planning Practice Guidance (PPG) in that it is not necessary, not relevant in planning terms and not reasonable in all other aspects.
Taking the above background into account the main issue in this appeal is whether the condition is necessary and reasonable.
Section 05
Reasons
Whilst access to the extension is not possible via the main dwellinghouse, and instead it is accessed through its own separate door, any other separate use or use that was not incidental to the primary use of the main dwelling would require separate planning permission. As such, a condition preventing such development is not necessary and would fail to meet this test, as set out in the National Planning Policy Framework and the PPG. As it would not meet this test, I do not need to consider the other tests further.
Section 06
Conclusion
For the above reasons, I find that the disputed condition is unnecessary. Consequently, I conclude that the appeal is allowed, and that the planning permission is varied by deleting condition No. 3.
