No verified development description has been extracted from an official decision PDF yet.
Section 02
Decision
The appeal is allowed and the planning permission Ref 25/00297/FUL for construction of two storey side extension at [site address] granted on 3 July 2025 by Broxtowe Borough Council, is varied by deleting Condition 6.
Section 03
Main Issue
The main issue is whether Condition 6 is necessary to protect the living conditions of neighbouring occupiers, with particular regard to privacy.
Section 04
Reasons
The officer report notes that the proposed extension would be positioned on the north‐eastern boundary of the appeal site, away from neighbouring properties. It identifies the nearest building as [address] [name], approximately 70 metres to the east, and concludes that no additional overlooking would arise. My site visit confirmed that the north‐eastern elevation windows would face the school field and not any neighbouring property at a distance where overlooking would occur.
Overall, the removal of Condition 6 would not bring the development into conflict with Policy 17 of the [name] 2 Local Plan (2019), which requires new development to safeguard an acceptable level of amenity for neighbouring properties.
Section 05
Conclusion
Condition 6 is not necessary and therefore fails to meet the tests set out in Paragraph 57 of the National Planning Policy Framework. I am satisfied that its removal would not result in any unacceptable impact on the living conditions of neighbouring occupiers. Accordingly, the appeal should be allowed.
