Section 03
Background and Procedural Matters
Planning permission was granted for alteration and extension of existing detached outbuilding to form a one bedroom self-contained residential annex. A condition controlling the use of the development as an annexe/extension to the main dwelling was imposed as the site is considered unsuitable for the establishment of a separate self-contained dwelling unit because of the degree of detriment to the amenities of surrounding residential properties that would arise. Condition 3 therefore states that the development hereby permitted shall be used only insofar as it forms an annexe/extension to the dwelling currently known as [site address] , and shall at no time be occupied as a separate or self-contained dwelling unit. The proposed development seeks to vary this condition to ultimately create a new planning unit by using the annex as a dwelling separate from the original main dwelling.
In doing so however, the current appeal under Section 73A of the Town and Country Planning Act 1990 would obtain a permission that would require a variation to the terms of the ‘operative’ part of the planning permission, that is, the description of the development for which the original permission was granted. To this end, the original permission as set out above reads, alteration and extension of existing detached outbuilding to form a one bedroom self-contained residential annex. Bold emphasised by the Inspector.
There are no powers under Section 73A of the Act to grant a new planning permission with a different operative part to that contained in the original permission. If amending a condition would result in a conflict between it and the description of development, then that particular amendment is beyond the powers under Section 73A and cannot be made (a fresh planning application would be required). Accordingly, as a conflict has arisen with the original description of the development, the appeal cannot therefore be dealt with under Section 73A and will be dismissed on this ground. In such circumstances, there is no need to consider any of the wider issues.
Section 04
Conclusion
For the reasons given, the appeal is dismissed.
