Section 01
Development description
change of use from Class E (Pharmacy) to [name] ([name]/retail).
Section 02
Decision
The appeal is allowed and the planning permission Ref 25/01193/FUL for change of use from Class E (Pharmacy) to [name] ([name]/retail) at [site address] granted on 11 November 2025 by Rushcliffe Borough Council, is varied by deleting condition 2 and substituting with the following condition: The use hereby permitted shall only take place between the following approved hours: - Monday – Sunday 0900 – 2000 Hours
Section 03
Background and Main Issue
The proposal seeks to vary condition 2 to allow for extended opening hours. The main issue is therefore the effects on the living conditions of the occupiers of neighbouring properties.
Section 04
Reasons
The appeal site is located within a row of properties that are in commercial use with other commercial properties also within the locality. There are residential properties in the area however, these are not located within close proximity to the appeal site.
The appellant has provided a list of the other commercial units in the area including the opening times of these properties. The Council have also provided a similar list indicating which properties have restrictions on opening hours. It is apparent that the majority of the commercial properties in the area do not have any restrictions on opening hours and those that do are mostly restricted to opening until around 2300 hours. A response has also been received from the Council’s Environmental Health Officer stating that the proposed hours of operation of Monday to Sunday 0900 to 2000 hours would be acceptable.
Given the type of use of the property, the distance from residential dwellings and that other commercial units in the area would be operating at similar times, the proposed variation in the opening times would not have an adverse effect on the living conditions of neighbouring residential occupiers.
Accordingly, I find that the proposal would not have a harmful effect on the living conditions of the occupiers of neighbouring properties. The proposal would be in accordance with Policy 1 of the Rushcliffe Local Plan Part 2: Land and Planning Policies which seeks development to not have a significant adverse effect upon the residential amenity of adjoining properties or the surrounding area.
Section 05
Conclusion
For the reasons given above I conclude that the appeal should succeed. I will vary the planning permission by deleting the disputed condition 2 and substituting with the condition detailed in paragraph one.
