Section 03
Appeal Procedure and Recommendation
The site visit was undertaken by a representative of the Inspector whose recommendation is set out below and to which the Inspector has had regard before deciding the appeal.
The appeal follows a householder application for planning permission to extend a dwelling. On my site visit, I observed that substantial demolition works have been carried out at the appeal site and that only very limited remnants remained of the dwelling that the appeal proposal seeks to extend. Having raised the matter with the appellants, they suggest that they are implementing a previous planning permission at the site to extend the dwelling1 (the existing permission). The appeal proposal is similar to the existing permission but includes the addition of an attached garage to the side and an additional single storey rear extension.
However, from my own observations on site it appears that the dwelling has been substantively demolished. The approved plans for the existing permission and the plans submitted with the appeal include a key confirming which walls are to be demolished and also, importantly, the ‘existing’ walls to be retained. I noted on my site visit that the internal walls which formed a significant proportion of the ‘existing’ dwelling to be retained have been largely demolished. As such, the totality of demolition works undertaken is extensive and appears to have gone significantly beyond what is shown on the plans for both the existing permission and the drawings submitted with the appeal.
Given the extent of demolition undertaken and that what is on site differs from the proposed drawings, I can only conclude that the dwelling that the planning application sought to extend is not there. The appellant has not provided any 1 Council Ref 25/P/00285 contrary evidence to demonstrate that as a matter of fact the dwelling is there to extend. It is therefore not necessary or appropriate to consider the matters arising from the Council’s decision notice, specifically whether the ‘proposed extensions’ would be inappropriate development in the Green Belt.
Section 04
Conclusion and Recommendation
For the reasons given above and having had regard to all other matters raised, I recommend that the appeal should be dismissed.
Section 05
Inspector’s Decision
I have considered all the submitted evidence and my representative’s report and on that basis the appeal must fail and is dismissed.
