Walls and fenestration to the principal front and rear elevations of the building at the new proposed first floor level, including masonry walls to match the existing and roof tiles and pitch to match the existing, with all hips and valley replicated.

  1. Section 02

    Decision

    The appeal is dismissed.

  2. Section 03

    [name]

The provisions of Article 3(1), Schedule 2, Part 1, Class AA of the Town and Country Planning (General Permitted Development) (England) Order 2015 as amended (GPDO), subject to limitations and conditions, grants planning permission for the enlargement of a dwellinghouse through the construction of additional storeys. As set out in the GPDO, the developer must, before beginning the development, apply to the local planning authority for a determination as to whether the prior approval of the authority will be required.

  3. Section 04

    [name]

The main issues are: • Whether any additional storey is constructed other than on the principal part of the dwellinghouse; and • Whether prior approval should be granted having regard to the external appearance of the dwellinghouse.

  4. Section 05

    Reasons

The appeal site is formed of an extended bungalow set within a spacious and leafy plot. The bungalow is constructed from facing brickwork with a central element and subservient parts either side defined by a lower ridge height. The bungalow has been extended to the rear including in the form of a conservatory and modest flat roof element. [address] is characterised by large detached dwellings of varying sizes and designs set within spacious plots.

[name].1(i) states that development is not permitted if any additional storey is constructed other than on the principal part of the dwellinghouse.

[name].4 defines the ‘principal part’ of the dwellinghouse as ‘the main part of the dwellinghouse excluding any front, side or rear extension of a lower height, whether this forms part of the original dwellinghouse or is a subsequent addition’.

I acknowledge that the parts of the dwelling either side of the central section have the same eaves height. However, on account of their lower roof heights compared to the central section I am of the view that these parts do not form the main part of the dwellinghouse. Therefore, the scheme as proposed would not be solely constructed on the principal part of the dwellinghouse.

Whilst the appellants comments are noted, it is not for me under consideration of a s78 appeal to come to a view as to whether a scheme is or is not within the spirit of the GPDO. My determination is focused upon the contents of the GPDO.

Consequently, I conclude that the proposed development does not comply with Schedule 2, Part 1, Class AA of the GPDO.

  5. Section 06

    Other Matters

[name] have found that the proposal is not permitted development, it is not necessary for me to consider the external appearance of the dwellinghouse.

  6. Section 07

    Conclusion

For the reasons set out above the appeal does not succeed.
