Section 01

Section 02
Decision
The appeal is dismissed.
Section 03
Main Issue
I consider the main issue to be the effect of the development on the character and appearance of the surrounding streetscene.
Section 04
Reasons
The appeal site lies in a prominent location in a row of dwellings within a semi-rural area. Boundary treatments in the surrounding area comprise a mix of open boundaries and low brick walls, railings, open fences or established hedgerows. Where there are hard front boundaries, they are predominately softened by planting. The hedging at the appeal site has been removed and the UPVC fencing to the side and front and gates have been erected. The fencing is horizontal composite grey panels, around some1.6 metres in height, which I understand is a similar height to the hedging it has replaced.
From my observations, due to the design, scale, prominent position, materials and colour of the fencing and gates, I consider that they appear as incongruous additions to this semi-rural street scene. They introduce an enclosing urbanising form, which is unacceptably dominant in the streetscene. A line of laurel planting has been introduced along the frontage. This has a limited impact on softening the appearance of the front boundary but there is no screening of the side fencing from the wider view from the main B581 road.
In reaching my decision, I have had regard to all matters raised, including examples of other boundary treatments in the surrounding area. I find none to be directly comparable to the development, especially in terms of form and materials.
I note the personal family circumstances and realise that the fence and gates provide essential containment and protection, particularly given the proximity of a fast-moving carriageway beyond the residential service road. This is a material consideration. Nevertheless, the development is not the only way to achieve the necessary protection. Thus, I have attributed limited weight to this matter in my determination of this appeal. This matter does not outweigh the significant harm that the development causes to the character and appearance of the surrounding streetscene.
For the reasons stated above, the development is contrary to Policies CS2 and CS18 in the Blaby District Local Plan ([name]) Development Plan Document (2013) and Policy DM2 a) and bi) in the Blaby District Local Plan (Delivery) Development Plan Document (2019), particularly where they seek to ensure that development is in keeping with the appearance and character of the existing development form. The proposal would be contrary to the National Planning Policy Framework where the Framework seeks to ensure good design that is sympathetic to local character. The above policies are broadly in accordance with the Framework on this matter.
