Section 01

described as ‘reserved matters application for the approval of appearance, layout and scale on approved planning application 23/00201/OUT (Outline planning permission (with all matters reserved for future determination) for erection of five dwellings’.
Section 02
Decision
The appeal is dismissed.
Section 03
Preliminary Matters
As my decision relates to a matter of procedure, site factors are not determinative. Therefore, I have not undertaken a site visit in this instance.
In the interests of accuracy, I have adopted the Council’s description of development which better reflects that it relates to a reserved matters application.
Section 04
Procedural Matters
On 6 July 2023, outline planning permission was granted for the erection of five dwellings. All matters were reserved for subsequent consideration. Condition 1 of that planning permission required that details were subsequently submitted for matters of appearance, landscaping, layout and scale. Although it does not explicitly say so, this should also refer to access which the Council have confirmed was a drafting error. The appellant made an application to the Council for approval of some of those reserved matters in May 2025, and the refusal of that application is the subject of this appeal.
The outline planning permission was for the erection of five dwellings. Within the description of development, the quantum was expressed as an absolute. The reserved matters application has utilised the entirety of the site upon which outline permission was sought and granted. Noting that only four dwellings are shown on the proposed plans, there is no land reserved for the approved fifth dwelling to be laid out. As such, the reserved matters application is inconsistent with the terms of the outline permission.
The reserved matters scheme is a different scheme to that which was granted outline planning permission. Consequently, neither the application nor the appeal have been validly made, pursuant to the outline planning permission. Both main parties have had the opportunity of making representations on this matter, so my findings should not come as a surprise.
It is not possible for me to deal with the appeal as though it were a full application as some details are not before me. Moreover, interested parties would be prejudiced by this approach as the proposal would not have been properly advertised.
It is not necessary to consider the merits of the scheme as it would not alter the outcome of the appeal.
Section 05
Conclusion
For these reasons, I must dismiss the appeal on procedural grounds.
