Section 01

Development description

for the conversion of existing integral garage to habitable space; first- floor extension over. Construction of a new detached garage.

  1. Section 02

    Decision

The appeal is allowed and planning permission is granted for the conversion of existing integral garage to habitable space; first-floor extension over. Construction of a new detached garage at [site address] in accordance with the terms of the application, Ref 25/01774/HFUL, dated 18/11/2025 and the plans submitted with it, subject to the following

  2. Section 03

    conditions:

The development hereby permitted shall begin not later than three years from the date of this decision.

The development hereby permitted shall be carried out in accordance with drawing Nos. XXX-00 Location, Site & [name], 592-01 [name] & Elevations and 590-02 [name] & Elevations.

The external materials of the development hereby permitted shall match those used in the existing dwelling.

  3. Section 04

    Preliminary Matters and Reasons

The appeal is against a failure of the Council to give notice of its decision on the planning application within the prescribed period. As such, there is no decision notice. However, the Council’s appeal statement sets out that it would have granted permission, subject to conditions, had it determined the planning application.

Assessing various matters relevant to the appeal proposal, the Council’s appeal statement indicates that the proposed development accords with the adopted development plan, which includes the [site address] [name] 2011-2031 and Kettering Site Specific Part 2 Local Plan (December 2021). My assessment of the submitted evidence and site visit observations do not lead me to a different conclusion. Moreover, no representations from interested parties have been submitted that raise objection to the proposal.

  4. Section 05

    Conditions

In addition to the standard time condition, I have imposed a condition requiring that the development is carried out following the approved plans, for the avoidance of doubt and in the interests of certainty. A matching materials condition is required to ensure that the character and appearance of the area is maintained.

  5. Section 06

    Conclusion

For the reasons given above, I conclude that the proposal would be in accordance with the development plan as a whole and there are no material considerations that indicate that the development should be determined otherwise than in accordance with it. Therefore, the appeal is allowed.
