Section 02
Decision
The appeal is allowed and planning permission is granted for a single storey rear mono pitched roof extension at [site address] in accordance with the terms of the application, Ref 25/01573/HFUL, dated 23/10/2026 and the plans submitted with it, subject to the following conditions:
The development hereby permitted shall begin not later than three years from the date of this decision.
The development hereby permitted shall be carried out in accordance with drawing Nos: 695-00 Location, Site & [name], 695-01 [name] & Elevations and 695-02 [name] & Elevations.
The external materials of the extension hereby permitted shall match those used in the existing dwelling.
Section 03
Preliminary Matters and Reasons
I have taken the description of development in the banner heading above from the acknowledgement letter of the Council dated 21 November 2025 as it corrects a minor typographical error that is included within the description on the application form. Whilst there is no record of a formal agreement to the change in front of me, given that the updated description is utilised by the appellant on their appeal form, I am satisfied that neither party is prejudiced by this course of action.
The appeal is against a failure of the Council to give notice of its decision on the planning application within the prescribed period. As such, there is no decision notice. However, the Council’s response to the appeal states it would have no objections to planning permission being granted, subject to conditions.
The Council refers to relevant policies of the [site address] [name] 2011-2031 and the Kettering Site Specific Part 2 Local Plan (December 2021). There is no claim that the proposal would be contrary to any of these policies and my assessment of the submitted evidence and site visit observations do not lead me to a different conclusion. Moreover, no interested parties have submitted comments on the development.
Section 04
Conditions
In addition to the standard time condition, I have imposed a condition requiring that the development is carried out following the approved plans, for the avoidance of doubt and in the interests of certainty. A matching materials condition is required to ensure that the character and appearance of the area is maintained.
Section 05
Conclusion
For the reasons given above, I conclude that the proposal would be in accordance with the development plan as a whole and there are no material considerations that indicate that the development should be determined otherwise than in accordance with it. Therefore, the appeal is allowed.
