Section 01
Development description
prior approval for the excavation of lagoon to store whey washings as a soil improver.
Section 02
Decision
The appeal is dismissed.
Section 03
Main issue
The main issue is whether the proposal would amount to permitted development.
Section 04
Reasons
[name].2 of the GPDO says, amongst other things, that the carrying out of excavations is permitted subject to the condition that the developer must, before beginning the development, apply to the local planning authority for a determination as to whether the prior approval of the authority will be required as to the siting of the excavation.
A.2. (2) (iii) advises that the development must not begin before either the receipt by the applicant from the local planning authority of a written notice of their determination that such prior approval is not required; or where the local planning authority give the applicant notice within 28 days following the date of receiving the applicant's application of their determination that such prior approval is required, the giving of such approval; or the expiry of 28 days following the date on which the application was received by the local planning authority without the local planning authority making any determination as to whether such approval is required or notifying the applicant of their determination.
From the evidence before me, noting the officer report identifies that an extension of time has been agreed by the parties, thus extending the 28-day period for determination, none of the aforementioned decision outcomes in A.2 (2) (iii) had been reached at the relevant time.
Within that context, at my site visit, I saw that the development had already been carried out and appeared substantially complete. The form, scale, and layout of the lagoon broadly reflected the submitted plans. Because prior approval cannot be given for development that has already begun, I must therefore conclude that the proposal would not amount to permitted development.
Section 05
Other matters
I have had regard to the appellant’s submissions regarding the absence of harm and the Council’s evolving stance on the proposal. However, these matters do not alter my findings on whether the development complies with the requirements of the GPDO.
Given my conclusion that the scheme cannot be permitted development, I do not need to consider whether or not the storage of whey washings would be reasonably related to the farming activities and necessary for the purposes of agriculture within the unit.
Section 06
Conclusion
For the reasons given above, the appeal is dismissed.
