Section 01
Development description
the installation of a trough lit 32 sheet externally illuminated advertising display.
Section 02
Decision
The appeal is dismissed.
Section 03
Procedural Matters
The Town and Country Planning (Control of Advertisements) (England) Regulations 2007 (the Regulations) require that applications for the display of advertisements are considered in the interests of amenity and public safety, taking into account the provisions of the development plan, so far as they are material, and any other relevant factors. Factors relevant to amenity include the general characteristics of the locality, including the presence of any feature of historic, architectural, cultural or similar interest.
Section 04
[name]
The main issues are the effects of the proposed advertisement on visual amenity.
Section 05
Reasons
The appeal property forms one end of a 2-storey terrace situated next to the junction between [address] and [address]. The former is a busy street comprising a mix of small-scale retail, café and restaurant uses at ground floor level with flats above. The latter is a residential street.
On the upper part of the flank wall of the appeal property, facing [address], there is an unilluminated 48 sheet advertisement display, which is highly conspicuous in views looking along [address]. The proposal would replace this with a trough-lit 32 sheet display. Whilst this would be narrower than the display it would replace, making it slightly less conspicuous during the day, it would be illuminated, making it far more prominent and intrusive during hours of darkness.
Due to its location close to residential properties, its size and its illuminated nature I therefore conclude that the proposed advertisement would be harmful to the visual amenity of local residents.
I have taken into account the policies cited in the Council’s reason for refusal which seek to protect amenity and are therefore material in this case. [name] have concluded that the proposal would harm amenity, it follows that it conflicts with these policies.
Section 06
Conclusion
For the reasons set out above, and having regard to all other matters raised, I conclude that the appeal should fail.
