Babergh District Council appeal findings
Rear-garden traffic and front-garage harm
The selected examples lean more towards dismissed appeals than the matched local set. The allowed extract gives no physical design detail.
Counted against appeals
Rear gardens and street setbacks
Full-length driveway changed rear gardens
In 53073, garage access along the garden’s full length was found uncharacteristic and readily visible in otherwise open, tranquil rear gardens.
Forward garage reduced street spaciousness
In 89726, a forward garage was harmful because comparable setbacks of nearby homes gave the street its spacious appearance.
Character harm stated without detail
The extracts for 85104 and 50035 state character harm, but do not describe a physical feature.
Helped or needed
Design complementing the dwelling and area
Design complemented the dwelling and area
In 60170, the Inspector said the design complemented the host dwelling and surrounding area. The extract names no physical feature.
Your refusal notice
Check these details
- Does the refusal identify parking or vehicle movement through a rear garden?
- Does it say front setbacks give the street a spacious appearance?
- Does your evidence identify features that complement the dwelling and area?
The allowed extract gives a conclusion, not the proposal’s physical design details. These decisions do not predict another result.

Compare allowed and dismissed appeal reasoning
Each example separates the development, the Inspector-stated issue that selected it, and the reasoning from the decision. Compare the facts as well as the outcome: these examples do not predict how a different proposal would be decided.

Development described in the decision
No verified development description was available for this example.
Issue identified by the Inspector
The effect of the proposal on the character and appearance of the surrounding area.
Paragraph 3 · Source page 1
Reasoning from the decision
Overall, I find that the proposal would not materially harm the character or appearance of the host dwelling or the surrounding area. Consequently, I find that the proposal complies with policies LP17 and LP24 of the Babergh and Mid Suffolk Joint Local Plan – Part 1 (2023), policy EMST12 of the Elmsett Neighbourhood Plan (2019) and paragraph 135 of the National Planning Policy Framework (Framework) in terms of the positive impact of its design that complements the character of the surrounding area and the host dwelling.

Development described in the decision
erection of rear garaging/garden room including new block paved driveway.
Issue identified by the Inspector
The main issue is the effect of the proposal on the character and appearance of the appeal site and the surrounding area.
Paragraph 4 · Source page 1
Reasoning from the decision
The proposal includes a new block paved driveway that would run from the existing parking area to the side of the dwelling the full length of the garden to the front of the proposed building, providing access to the three garage spaces. There are examples of detached garages to the rear of neighbouring properties, but these are directly behind the dwellings, rather than at the end of the garden as proposed here. The vehicle movements associated with the use of the three garage spaces would, therefore, be uncharacteristic of the surrounding area. Moreover, the use of the full length of the garden for such movements and parking would be readily apparent to neighbouring residents, contrary to the otherwise open and relatively tranquil character of the rear gardens. As such, the garages and driveway and their associated use would be incongruous features in this location, resulting in material harm to the area’s character and appearance.

27 February 2026 · Dismissed
Development described in the decision
erection of a garage/workshop.
Issue identified by the Inspector
The main issue is the effect of the proposal on character and appearance of the appeal site and the surrounding area.
Paragraph 4 · Source page 1
Reasoning from the decision
For the above reasons, I conclude that the proposal would have a materially harmful effect on the character and appearance of the appeal site and the surrounding area. This draws the proposal into conflict with Policies SP09 and LP24 of the Babergh and Mid Suffolk Joint Local Plan 2023 and Policy NEWT 3 of the Newton Neighbourhood Plan 2022. Collectively, amongst other things, these policies require development to be of high-quality design, including responding to and safeguarding the existing character and context.

2 June 2026 · Dismissed
Development described in the decision
an attached front double garage.
Issue identified by the Inspector
The main issue is the effect of the development upon the character and appearance of the building and the area.
Paragraph 3 · Source page 1
Reasoning from the decision
However, the existing dwelling and the properties immediately adjoining it, are set back from the road by comparable, though not by identical amounts, and this contributes positively and distinctively to the spacious character and appearance of the street scene. The proposed extension, by its forward position, would be significantly harmful and would not assimilate in a sufficiently acceptable way into the character and appearance of the host property or street scene.

Development described in the decision
No verified development description was available for this example.
Issue identified by the Inspector
The effect of the proposal on the character and appearance of the main building and the surrounding area.
Paragraph 2 · Source page 1
Reasoning from the decision
Whilst the proposal would provide the benefit of additional living accommodation, I find that this does not outweigh the harm caused by the proposal to the character and appearance of the street scene and the conflict with the development plan outlined above.
