Castle Point Borough Council appeal findings

Castle Point character: side gaps and minor changes

The selected examples include both outcomes. One dismissed extract gives only a conclusion, so it cannot show the detail behind its harm finding.

Counted against appeals

Side gaps and rear extensions

  1. Bulk in the side gap

The Inspector said the addition’s bulk and position would significantly encroach into the gap beside the adjacent property, eroding its spacious setting.

  2. Rear extension detracted

The Inspector concluded that the first-floor rear extension detracted from the appeal property and its surroundings.

Helped or needed

Minor changes in varied streets

  1. Minor changes matched varied buildings

The Inspector treated the side extension and false pitched roof as minor changes appropriate within an area of diverse buildings.

  2. No street-scene harm found

The selected extract concludes that the front/side extension would not harm the surrounding street scene, without giving more design detail.

  2. Are your changes minor beside the buildings around your home?
  3. Does the refusal explain harm to your property and surroundings?

Appeal 678’s selected extract gives only a harmful conclusion, not the reasons behind it. These decisions do not predict another result.

Allowed appeal examples

2 examples

  1. 3329340

    12 April 2024 · Allowed

    Development described in the decision

a front/side extension with internal alterations.

    Issue identified by the Inspector

The main issue in this appeal is the effect of the proposed development on the character and appearance of the area.

    Paragraph 3 · Source page 1

    Reasoning from the decision

Consequently, I conclude that the appeal proposal would not harm the character and appearance of the area. As such, it would be consistent with Policy EC2 of the Castle Point Borough Council Local Plan, Adopted 1998, which seeks to ensure that extensions to buildings achieve a high standard of design, and are not harmful to the character of its surroundings. It would also be consistent with the guidance in the RDG, which requires development to integrate with or complement the host dwelling and those in the surrounding street scene.

  2. 3369984

    28 October 2025 · Allowed

    Development described in the decision

construction of ground floor side extension connecting detached garage with main dwelling and retention of crown roof above existing side extension.

    Issue identified by the Inspector

The main issue is the effect of the proposed development on the character and appearance of the surrounding area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

Policy EC2 of the Castle Point Local Plan (1998) requires a high standard of design in extensions and alterations with, amongst other matters, regard to be paid to the setting of a building and the character of its surroundings. The Castle Point Borough Council Residential Design Guidance sets out at RDG2 guidance that the space around all new development should be informed by the prevailing character of space around dwellings. It is evident to me from the site visit that the proposed changes to the appeal property would be a minor alteration to the host property and the wider area, appropriate to the existing character and appearance of that area. The false pitched roof is a further minor change to the building and wider area, where there is diversity in buildings. Thus, the proposals would be consistent with the development plan and the design guidance.

Dismissed appeal examples

3 examples

  1. 3366619

    11 July 2025 · Dismissed

    Development described in the decision

    first floor rear extension.

    Issue identified by the Inspector

The main issue is the effect of the proposal on the character and appearance of the appeal property and the surrounding area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

I therefore conclude that the proposal would detract from the character and appearance of the appeal property, and in so doing, its surroundings, contrary to LP Policy EC2 and guidance in the RDG. It would not accord with the design objectives of the National Planning Policy Framework, which requires developments to be visually attractive as a result of good architecture and sympathetic to local character, including the surrounding built environment.

    Paragraph 11 · Source page 2

  2. 3272850

    15 September 2021 · Dismissed

    Development described in the decision

a single-storey side, rear extension, garage conversion into games room and hip to gable loft conversion with dormer.

    Issue identified by the Inspector

I consider the main issue to be the effect of the proposal on the character and appearance of the surrounding area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

The proposed single-storey side addition would encroach significantly into the side gap with the adjacent property. Due to the bulk and position of this proposed addition, I consider that it would unacceptably erode the spacious setting of the existing dwelling. This would be to the detriment of the distinct character and appearance of the surrounding area, where the spatial pattern of development would be significantly disrupted.

    Paragraph 6 · Source page 2

  3. 3265623

    14 July 2021 · Dismissed

    Development described in the decision

retrospective application to show added hip to gable roof with rear dormer to previously approved plans (19/0261/FU – Demolition of garage, adjoining corridor and porch, construction of single storey rear and side extensions including bay windows to front and front porch extension).

    Issue identified by the Inspector

I consider that the main issue is the effect of the proposal on the character and appearance of the area.

    Paragraph 3 · Source page 1

    Reasoning from the decision

I have considered all other matters raised but none alter my conclusion. I conclude that the proposal would have a harmful effect on the character and appearance of the area and would conflict with Local Plan Policy EC2, the SPD and the Framework. The appeal therefore fails.
