Allowed appeal examples

2 examples

  1. 3320055

    29 June 2023 · Allowed

    Development described in the decision

first floor extension to provide additional bedroom over existing flat roof garage.

    Issue identified by the Inspector

The main issue of the appeal is the effect of the proposed development on the character and appearance of the area.

    Paragraph 7 · Source page 2

    Reasoning from the decision

For the reasons given above, I therefore conclude that the proposal would not harm the character and appearance of the area. Accordingly, I find no conflict with Policies SE1 and SD2 of the Cheshire East Site Allocations and Development Policies Document 2022 (SADPD), Policies GEN1 and HOU11 of the Cheshire East Local Plan 2010–2030 (CELP) or Policy BE2 of the NP. In combination, these policies seek to, amongst other things, protect the character and appearance of the area.

a double storey side extension to form ground floor storage and utility area and first floor bedroom and shower room.

    Issue identified by the Inspector

The main issue is the effect of the proposed development on the character and appearance of the area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

In summary, therefore, the proposed development would have a harmful effect on the character and appearance of the area. Consequently, in that respect, it would be contrary to Policies SE1 (Design) and SD2 (Sustainable Development Principles) of the Cheshire East Local Plan, Policies HOU11 (Alterations and Extensions) and HOU13 ([name]) of the Site Allocations and Development Policies Document, and Policy H6 ([name]) of the Alsager Neighbourhood Plan.

  2. 6005167

    1 April 2026 · Dismissed

    Development described in the decision

    for a replacement boundary wall.

    Issue identified by the Inspector

The main issue is the effect of the proposed development upon the character and appearance of the area.

    Paragraph 4 · Source page 1

    Reasoning from the decision

The development also conflicts with policies GEN1 and HOU11 of the [site address] Site Allocations Development Policies Document 2022, which require development to be of good design in keeping with the character and appearance of the area in which it is set. Moreover, it does not comply with policy H4 of the Wybunbury Combined Parishes Neighbourhood Plan 2020 in so far as it requires boundaries facing the street to be ‘low rise’, nor with chapter 12 of the Framework which requires development to be consistent with the character and appearance of the area. 3. 3371691

    31 October 2025 · Dismissed

    Development described in the decision

described as “retention of front wall incorporating alterations to respond to the refusal of planning application 23/4459C”.

    Issue identified by the Inspector

The main issue is the effect of the proposed development on the character and appearance of the surrounding area.

    Paragraph 3 · Source page 1

    Reasoning from the decision

I therefore find that the proposed development would cause significant harm to the character and appearance of the surrounding area. Accordingly, the development would conflict with Policies SE1 and SD2 of the [site address] Local Plan Strategy 2010-2030 (July 2017) which, amongst other things, expects new development to contribute positively to an area’s character and identity, reinforcing local distinctiveness including with regard to height and choice of materials. It would also conflict with Policy GEN1 of the Site Allocations and Development Policies Document (December 2022) and Policy H6 of the Alsager Neighbourhood Plan 2018-2030 which seek to create high quality places and good quality design that responds to and integrates with local surroundings and the built environment.
