Your refusal notice
Check these details
- Does the notice identify a visible feature such as a wall’s height, length or materials?
- Does it explain how your building’s overall design harms the surrounding area?
- Is the refusal about a conservation area as well as wider area character?
Appeal 65280 concerns a conservation area, so it sits at the edge of this wider issue page. These decisions do not predict another result.

13 August 2025 · Allowed
Development described in the decision
No verified development description was available for this example.
Issue identified by the Inspector
The main issue is the effect of the development on the character and appearance of the area.
Paragraph 5 · Source page 1
Reasoning from the decision
Consequently, the development has an acceptable effect on the character and appearance of the area. In that regard, it complies with Policies SP7 and DM15 of the Colchester Borough Council Local Plan (2022) and Policy TIP02 of the Tiptree Neighbourhood Plan (2023) which amongst other things require development to respect their context and to integrate with local surroundings. The proposal would also accord with the requirement at Paragraph 135 of National Planning Policy Framework for development to be sympathetic to local character including the surrounding built environment.

25 October 2023 · Dismissed
Development described in the decision
described as removal of Conservatory and Part removal of existing dwelling to allow for New 2 [name].
Issue identified by the Inspector
The main issue in this appeal is the effect of the proposed development on the character and appearance of the area.
Paragraph 3 · Source page 1
Reasoning from the decision
I conclude that the proposed development would harm the character and appearance of the area. There is conflict with Policy SP7 of the Colchester Borough Council Local Plan 2013-2033 Section 1 (2021), and Policies DM13 and DM15 of the Colchester Borough Local Plan 2017-2033 Section 2 (2022) which amongst other things seek to ensure developments are of high standard of design which positively respond to its context area and that extensions are subordinate to the original dwelling.
Paragraph 6 · Source pages 1, 2
2 March 2022 · Dismissed
Development described in the decision
a retrospective application for demolition of 1.8m (6ft) fence and replacement with brick wall.
Issue identified by the Inspector
The main issue is the effect of the development on the character and appearance of the surrounding area.
Paragraph 3 · Source page 1
Reasoning from the decision
The boundary wall that now exists is highly visible on the approach to the site. This is largely due to its overall height, length and the colour of the brick used in its construction. These combined, and viewed in the context of the surrounding area, mean that the development forms an incongruous, urban addition to the street scene which accordingly harms the character and appearance of the area.
Paragraph 7 · Source page 2
29 June 2026 · Dismissed
Development described in the decision
proposed replacement of agricultural building with a self- build/custom build new dwelling. (In lieu of [name] for conversion of building into a dwelling 221000).
Issue identified by the Inspector
The main issue is the effect of the proposed development on the character and appearance of the surrounding area.
Paragraph 3 · Source page 1
Reasoning from the decision
I therefore conclude that the proposal’s overall design would not have an acceptable impact upon the character and appearance of the surrounding area. On this basis the proposal does not comply with Policy SP7 of the Colchester Borough Local Plan 2013-2033 Section 1 [name] 2021 that seeks to ensure that all development meets high standards of architectural design, as well as preserve and enhance the character the area. The proposal also does not comply with Policies DM15, OV2 and ENV1 of the Local Plan Colchester Borough 2017-2033 Section 2 [name] 2022 that in total also seek to ensure high quality design that protects the rural character of an area. The proposal also does not comply with Framework, given that the proposal does not reflect a high quality design.
Paragraph 9 · Source page 2
26 February 2025 · Dismissed
Development described in the decision
replacement of shed with lean to and repositioning of front wall and pillar.
Issue identified by the Inspector
The main issue in this appeal is the effect of the proposed development on the character and appearance of the conservation area.
Paragraph 4 · Source page 1
Reasoning from the decision
For the reasons set out above, the proposal would harm, and thus would not preserve, the character and appearance of the CA. This would fail to satisfy the requirements of the Act and paragraph 210 of the Framework.
