Allowed appeal examples

  1. 3347339

    23 December 2024 · Allowed

    Development described in the decision

conversion of residential annex to dwellinghouse.

    Issue identified by the Inspector

Taking into account the above background, the main issue is whether the condition is reasonable or necessary in the interests of protecting the character and appearance of the area, the living conditions of neighbouring occupiers and highway safety.

    Paragraph 7 · Source page 2

    Reasoning from the decision

Consequently, for the above reasons, I conclude that it has not been demonstrated that there is ‘clear justification’ for the removal of PD rights and condition 4 of the recent permission is not reasonable or necessary, in the interests of protecting the character and appearance of the area, the living conditions of neighbouring occupiers and highway safety. As such, removal of this condition would not be contrary to Policies SS1, H1, DC1 and T1 of the Staffordshire Moorlands Local Plan 2020, which together and amongst other things require development to be high quality, which protects the amenity of the area and provides appropriate parking provision.

Dismissed appeal examples

4 examples

  1. 6005296

    29 April 2026 · Dismissed

    Development described in the decision

    a riding arena.

    Issue identified by the Inspector

The main issues in this appeal are as follows: • Whether the proposal would constitute inappropriate development in the green belt having regard to the National Planning Policy Framework (the Framework) and any relevant development plan policies. • The effect of the proposal on the character and appearance of the area. • The effect of the proposal on the living conditions of occupiers of adjacent dwellings. • Whether any harm to the green belt by reason of inappropriateness, and any other harm, is clearly outweighed by other considerations, so as to amount to the very special circumstances required to justify the proposed development.

    Paragraph 2 · Source page 1

    Reasoning from the decision

Notwithstanding my assessment of the proposal regarding the other reasons for refusal, I cannot agree that the fences of the arena would be imposing to occupiers of these properties at a distance of some 40m. There appeared to be few windows facing this direction and views from the garden areas of either property appeared unlikely. Even so, the arena would be observed through trees lining the field boundary and the idea that this would be so imposing so as to harm the living conditions of the occupiers of these properties is absurd.

    Paragraph 14 · Source page 3

  2. 6001970

    10 April 2026 · Dismissed

    Development described in the decision

described as ‘existing farmhouse will be completely refurbished and the low quality outbuildings will be demolished to provide 3 x new build properties.’

    Issue identified by the Inspector

The main issues are: • whether the proposed development would provide a suitable location for housing, having regard to the development strategy for the area; and • the effect of the development on the living conditions of existing and future occupants, and the effect on the wider environment, from contamination.

    Paragraph 4 · Source page 1

    Reasoning from the decision

For the above reasons, I find that there is sufficient information to understand the pre-commencement risk of contamination. Subject to the recommended conditions the potential effect of the development on the living conditions of existing and future occupants, and the effect on the wider environment, from contamination would be capable of being secured. In this regard, and notwithstanding the conclusion reached on the other main issue, the proposal would comply with Policy SD4 of the LP which seeks to protect people and the environment from unsafe, unhealthy, and polluted environments by ensuring that proposals avoid potential adverse effects.

    Paragraph 16 · Source page 3

  3. 6002574

    20 March 2026 · Dismissed

    Development described in the decision

the creation of a new dwelling within the current residential curtilage of number [site address] without complying with condition 2 attached to planning permission [name]/2023/0379, dated 15 October 2024.

    Issue identified by the Inspector

The main issue is the effect of the proposal on the living conditions of the residential occupiers of [address], with particular regard to overbearing and an unneighbourly form of development.

    Paragraph 9 · Source page 2

    Reasoning from the decision

Therefore, I conclude that the proposal would harm the living conditions of the neighbouring residential occupiers of No 51, with particular regard to an overbearing and unneighbourly form of development. Accordingly, it would conflict the residential amenity aims of Policy DC1 of the Staffordshire Moorlands Local Plan Adopted September 2020.

    Paragraph 16 · Source page 3

  4. 6001442

    20 February 2026 · Dismissed

    Development described in the decision

single storey extensions to front and rear, garage conversion, with alterations to roofs to side and over existing garage structure.

    Issue identified by the Inspector

The main issues are the effect of the proposal on:  The character and appearance of the surrounding area; and,  The living conditions of the occupiers at the host dwelling.

    Paragraph 2 · Source page 1

    Reasoning from the decision

The proposal would harm the living conditions of the occupiers at the appeal site and would harm the character and appearance of the area. It would therefore conflict with the development plan taken as a whole. There are no material considerations that indicate the decision should be made other than in accordance with the development plan. Therefore, for the reasons given, I conclude that the appeal is dismissed.
