Counted against appeals

Why designs harmed Hartlepool's local character

  1. Suburban details in rural surroundings

Stone detailing and a large glazed unit were seen as creating a suburban house, not one suited to rural surroundings.

  2. Harm to semi-detached homes

The Inspector concluded the proposal would harm semi-detached properties and the immediate surrounding area.

Allowed appeal examples

1 example

  1. 3282089

    26 November 2021 · Allowed

    Development described in the decision

a single storey side extension as garage with store, new driveway and a new fence to enclose rear garden on highway side.

    Issue identified by the Inspector

The main issue is the effect of the development on the character and appearance of the host dwelling and the surrounding area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

I conclude that the proposed development would not be unsympathetic with respect to its design, scale or siting and would therefore not have a harmful effect on the character and appearance of the host dwelling or the surrounding area. Accordingly, I find no conflict with Policies HSG11 and QP4 of the Hartlepool Local Plan which seek to resist poorly designed development or Paragraph 134 of the National Planning Policy Framework which seeks to achieve good design sympathetic to the local area.

Dismissed appeal examples

  1. 3340386

    14 May 2024 · Dismissed

    Development described in the decision

described as: ‘proposed garage extension to the side of existing dwelling’.

    Issue identified by the Inspector

The main issue is the effect of the proposed development on the character and appearance of the area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

For the above reasons, the proposed development would be harmful to the character and appearance of the area. It would conflict with Policies HSG11 and QP4 of the Hartlepool Local Plan (2023) which together seek to ensure new domestic extensions are of a size, design and use materials that are sympathetic to the host dwelling and reflective of the character of the area. The proposal would also fail to accord with the provisions of the Framework, which sets out that development that is not well designed should be refused.

    Paragraph 8 · Source page 2

  2. 3286210

    1 February 2022 · Dismissed

    Development described in the decision

a 2 No ground floor infill rear extensions to the existing bungalow, small 2 No storey front extension to part with new first floor level addition with a pitched tiled roof over the full extended ground floor footprint.

    Issue identified by the Inspector

The main issue is the effect of the proposal on the character and appearance of the area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

Notwithstanding the consideration given to the design of the proposed development, many of the proposed finishes and architectural features, such as the stone detailing and large glazing unit, are not in keeping with the character and appearance of the area. Furthermore, the proposed development would not take design cues from the residential properties seen in the surrounding landscape. Irrespective of the separation between properties and the mix of buildings in the area, the proposed development would create a house more suited to a suburban setting. It would therefore not reflect the surrounding built environment or be sympathetic to the rural character of the area.

    Paragraph 8 · Source page 2

  3. 3273284

    7 July 2021 · Dismissed

    Development described in the decision

described as “Proposed telecommunications installation: Proposed 20m Phase 8 [name]/W wrapround Cabinet at base and associated ancillary works”.

    Issue identified by the Inspector

The main issue is the effect of the proposal on the character and appearance of the surrounding area.

    Paragraph 3 · Source page 1

    Reasoning from the decision

The proposal would be an obtrusive feature that would have a harmful effect on the character and appearance of the surrounding area. The proposal would conflict with Policies INF5 and QP4 of the Hartlepool Local Plan 2018 and the National Planning Policy Framework which seeks all development to be designed to a high quality and positively enhance their location and setting; and have regard to design and siting techniques.

    Paragraph 7 · Source page 2

  4. 3298987

    24 August 2022 · Dismissed

    Development described in the decision

described as a single story extension including WC and porch area to front of property.

    Issue identified by the Inspector

The main issue in this appeal is the effect of the proposed development on the character and appearance of the semi-detached properties and immediate surrounding area.

    Paragraph 2 · Source page 1

    Reasoning from the decision

Accordingly, for these reasons, I conclude that the proposal would have an unacceptably harmful effect on the semi-detached properties and character and appearance of the immediate surrounding area. Consequently, it would be contrary to policies HSG11 and QP4 of the Hartlepool Local Plan (2018) and the National Planning Policy Framework (2021). These policies seek, amongst other matters, to ensure that new development would be designed to a high quality, be sympathetic to the existing dwelling and would not adversely affect the character of the surrounding residential area.
